PremLuxe Commission Terms of Service & License Agreement

Effective Date: Upon Commission Acceptance
Creator/Studio: PremLuxeBy commissioning services from PremLuxe, you (“Client”) agree to these Terms of Service (“TOS”) and License Agreement. If you do not agree, you may not commission work.This agreement applies to all services, including but not limited to:
VRChat Showcases
3D Assets & Textures
Quest & Optimized Conversions
Seamless Merges
Sculpting & ReriggingCommission Process & RequirementsCommission work begins only after full or half payment along with any other requirements has been received.PremLuxe reserves the right to decline any commission for any reason, including inappropriate or illegal content.Pricing & PaymentPrices are listed per service or as quoted individually.Deposits (if required) are non-refundable.Full payment must be received before final delivery unless otherwise agreed in writing.Chargebacks or payment reversals are considered a breach of contract and may result in:
Work being withheld
DMCA enforcement (if files are leaked or used)
Ban from future PremLuxe commissionsRevisions & ApprovalRevisions are limited to 1 free revision. Afterwards you must pay a fee.Additional revisions may incur extra fees.Final approval is required before delivery of the final files.If a client does not provide a revision request within 3 days, the work may be considered approved.Delivery & FilesDelivery is provided in the format agreed upon in the commission (e.g., FBX, UnityPackage, PNG).PremLuxe is not responsible for issues caused by third-party software, VRChat updates, or client-side technical issues.File optimization (e.g., Quest/Opti conversion) is provided within the agreed performance standards, but hardware differences may affect results.Ownership & LicensePremLuxe retains full ownership of all original files, source files, textures, assets, and work produced.Upon full payment, the Client receives a non-exclusive, non-transferable license to use the commissioned work for personal or approved commercial use as agreed.Allowed UsesIncluding in avatars or showcases for personal or commercial use if approvedProhibited UsesRedistributing, reselling, or sharing the raw filesClaiming PremLuxe’s work as your ownUsing the work in NFTs, AI datasets, or blockchain projectsUsing commissioned work on accounts or projects not approved by PremLuxeCredit must be given in commercial projects:
“Sculpt/Asset/Showcase by PremLuxe – [Carrd Link]”DMCA & Copyright EnforcementAll commissioned work is protected under U.S. copyright and DMCA law.PremLuxe reserves the right to file DMCA notices for unauthorized distribution, resale, or claims of ownership.Refunds & CancellationsDeposits are non-refundable.Refunds for completed work are not provided.Cancellation after work has started may result in partial payment being retained, depending on progress completed.Chargebacks or attempts to bypass payment will result in legal action, DMCA enforcement, and permanent commission bans.LiabilityPremLuxe is not responsible for:
VRChat or Unity updates that break models or showcases
Hardware, software, or platform limitations
User modification errors
Account bans or restrictions
Communication & ResponsivenessClients must respond to questions, updates, or revision requests in a timely manner.Lack of response may delay or terminate the commission.PremLuxe will not be responsible for delays caused by unresponsive clients.AgreementBy commissioning work from PremLuxe, you agree to all terms listed in this Commission TOS & License Agreement.
